Asa cum v-am informat, in data de 19.09.2013 s-a intrunit la sediul nostru Comitetul de initiativa T1/T4.
Am adus la cunostinta acestuia propunerea de formulare a unei plangeri penale care sa sanctioneze, sub aspectul savarsirii infractiunilor de inselaciune cu consecinte deosebit de grave, abuz in serviciu contra intereselor persoanelor ori neglijenta in serviciu, conduita bancii, a debitoarei si, mai recent, a administratorilor judiciari, atat anterioar cat si ulterior deschiderii procedurii.
Am prezentat Comitetului dificultatile pe care le intampinam in procedura judiciara, in special a contestatiei impotriva raportului privind cauzele insolventei, dificultati legate de obstinatia cu care banca si administratorii judiciari se opun administrarii de probe (in special expertiza contabila), fructificarii concluziilor raportului de inspectie fiscala legate de plata de servicii fictive precum si executarii obligatiilor contractuale din contractele dvs de vanzare-cumparare.
Intre timp, a avut loc si termenul de judecata din data de 25.09.2013, la Tribunalul Bucuresti, avand ca obiect atat dosarul principal de insolventa cat si cererile cumparatorilor de apartamente din blocurile T1/T4 si de locuri de parcare din blocul T3 de obtinere a proprietatii asupra acestor bunuri. Si in acest dosar intampinam aceeasi adversitate a bancii si administratorilor judiciari, favorizata de modul de conducere a sedintei de judecata de catre judecatorul sindic.
S-a formulat din nou de catre administratorii judiciari cererea de intrare in faliment, discutarea acesteia fiind amanata pentru data de 09.10.2013 dupa ce judecatorul a revenit asupra propriilor decizii de respingere a acestei cereri luate la termenul din 06.03.2013 si chiar la termenul din 25.09.2013! Prezenta dvs se dovedeste din nou necesara la acest termen de judecata viitor, ca si in celelalte dati.
De asemenea, celelalte doua procese aratate mai sus au fost amanate pentru data de 23.10.2013 pentru a se lua cunostinta de apararile formulate de catre banca si administratorii judiciari.
Am propus Comitetului T1/T4 onorariul aferent redactarii si formularii plangerii penale – 3000 EUR, la care se adauga TVA, si cel aferent asistentei juridice in fazele cercetarii penale si urmaririi penale – 7000 EUR, la care se adauga TVA. Propunerea Comitetului T1/T4 este ca aceste onorarii sa fie impartite intre toti aceia dintre dvs, reclamanti-cumparatori de apartamente in T1/T4, care inteleg sa sustina aceasta plangere.
Comitetul T1/T4 a decis ca un draft al acestei plangeri va fi formulat pana la inceputul saptamanii viitoare, urmand sa fie inaintat conducerii bancii, atat celei din Romania cat si celei din Grecia, precum si la conducerea BDO din strainatate. De asemenea, va fi solicitata conducerii din Romania a bancii o intrevedere anterioara datei de 09.10.2013. In cazul in care aceasta intrevedere va fi refuzata sau nu se va primi raspuns, s-a decis ca o delegatie a dvs, cat mai larga, se va deplasa la sediul central al bancii anterior termenului de judecata din data de 09.10.2013.
Ca urmare a opiniei Comitetului T1/T4 favorabila acestei initiative, va propunem si dvs formularea si depunerea acestei plangeri si onorariul aferent si masurile aratate mai sus, rugandu-va sa ne transmiteti prin e-mail punctul dvs de vedere.
Membrii Comitetului T1/T4 va vor contacta in aceste zile pentru a va afla opinia cu privire la aceasta initiativa si a tine legatura cu dvs in vederea organizarii actiunilor ce vor urma.

As I informed you, on 19.09.2013 there was a meeting at our headquarters of the T1/T4 Initiative Committee.
We brought to their attention the proposition to formulate a penal complaint that will sanction, under committing fraud with aggravated consequences, abuse against the personal interest or, at least, duty negligence, the behavior of the bank, of the debtor and, most recently, of the judicial administrators, both prior and after the opening of the insolvency proceedings.
We presented the Committee the difficulties we came across in the judicial procedure, especially in the contestation against the report on the causes of the insolvency, difficulties related to the obstinacy with which the bank and the judicial administrators oppose the administration of evidence ( especially the accountancy expertise), the fructification of the conclusions of the fiscal inspection related to the payment of fictitious services and the execution of the contractual obligations as specified in your sale/purchase contracts.
Meanwhile, a hearing took place on 25.09.2013, at the Bucharest Tribunal, involving both the main insolvency case as well as the demands of the buyers of the apartments in buildings T1/T4 and of the parking spaces in T3 to obtain ownership of these goods. In this case we have also encountered the same adversity from the bank and from the judicial administrators, favored by the way the syndic judge is leading the hearing.
The judicial administrators have asked again the bankruptcy, the discussion being postponed by the syndic judge for 09.10.2013 after the judge went back on his own decision to reject the request made at the hearing on 06.03.2013 and even at the hearing on 25.09 .2013! This proves once again that your presence is necessary at this next court hearing.
Also the other two trials were postponed to 23.10.2013 in order to allow us to take notice of the defenses formulated by the bank and the judicial administrators.
We have made the T1/T4 Committee a proposition regarding the fees related to the drafting and submitting of the penal complaint – 3000 EURO + VAT, and the fee related to the assistance and monitoring during the penal investigation – 7000 EURO + VAT. These fees are going to be divided between those of the claimants – buyers in T1/T4 – that will endorse this penal complaint.
The T1/T4 Committee decided that a draft of the complaint will be formulated by early next week, will be submitted to the bank management, both in Romania and in Greece and to the abroad headquarters of BDO (judicial administrator). We will also request a meeting with the management of the Romanian bank prior to 09.10.2013. If this meeting will be refused and or if we will not receive any answers, it was decided that a delegation of claimants will go to the Romanian headquarters of the bank prior the 09.10.2013 hearing.
Following the favorable opinion of the T1/T4 Committee on this initiative, we propose you the forming and submission of this complaint, the afferent fee, asking you to communicate us via e-mail your point of view.
The members of the T1/T4 Committee will contact you in the following days to find out your opinion regarding this initiative and to organize the ensuing actions.
