In afara de cumparatori nu a fost prezent niciun creditor! In aceste conditii, adunarea va fi reconvocata. In cazul in care, si la reconvocare, nu se va intruni cvorumul necesar, judecatorul sindic va decide utilitatea acestei masuri.<\/span><\/p>\n<p><span style=\"font-family: Garamond;\">In opinia noastra, asa cum am aratat si astazi cumparatorilor prezenti, aceasta adunare a creditorilor nu ne este utila, hotararea supusa ei (aprobarea cererilor cumparatorilor de a obtine transferul liber de sarcini al apartamentelor in stadiul actual de executie) fiind de competenta exclusiva a judecatorului sindic.<\/span><\/p>\n<p><span style=\"font-family: Garamond;\">In ce priveste solutia pronuntata in dosarul 24665\/3\/2010\/a42 (contestatia noastra impotriva raportului privind cauzele insolventei), care a avut termen la 12.06.2013, judecatorul sindic a respins exceptia netimbrarii contestatiei de catre creditor (!), urmatorul termen de judecata fiind stabilit la 11.09.2013, pentru cand se vor cita din nou partile in vederea \u201cdiscutarii probelor\u201d. Solutia este, aparent, favorabila noua, urmeaza insa ca, dupa redactarea incheierii, sa aflam in ce masura s-au pastrat masurile dispuse de catre instanta in sedinta de judecata (plata taxei de timbru de catre fiecare contestator \u2013 minuta face referire la un singur creditor &#8211; , insusirea probei cu expertiza, pentru care am achitat deja, in termenul legal, onorariul de expert dispus de catre instanta).<\/span><\/p>\n<p><span style=\"font-family: Garamond;\">Cu consideratiune,<\/span><\/p>\n<p><span style=\"font-family: Garamond;\">Mihai Neacsu<\/span><\/p>\n<p>Florin Vasile<\/p>\n<p>&nbsp;<\/p>\n<p>Dear Madams,\u00a0Dear Sirs,<\/p>\n<p><em id=\"__mceDel\">Creditors\u00a0meeting\u00a0today\u00a0could not\u00a0take any\u00a0decision\u00a0due to lack of\u00a0quorum.\u00a0Apart from the\u00a0buyers, no other creditor\u00a0was present!\u00a0In\u00a0these circumstances,\u00a0the meeting will\u00a0be\u00a0reconvened.\u00a0If\u00a0quorum will not be meet again\u00a0,\u00a0the syndic\u00a0judge\u00a0will\u00a0decide\u00a0the usefulness\u00a0of this measure.<br \/>\nIn\u00a0our opinion, as we\u00a0showed\u00a0today\u00a0to the\u00a0buyers\u00a0attending\u00a0this\u00a0meeting, the decision of the creditors\u00a0is\u00a0not\u00a0useful,\u00a0the decision\u00a0(to\u00a0approve free of charge\u00a0transfer\u00a0of the\u00a0apartments\u00a0in the actual state\u00a0of\u00a0execution)\u00a0is\u00a0the exclusive competence of\u00a0the syndic judge.<\/em><\/p>\n<p>Regarding\u00a0the outcome of the\u00a0case\u00a024665\/3\/2010\/a42\u00a0(our\u00a0appeal\u00a0against\u00a0the report on\u00a0the causes of\u00a0insolvency), held on\u00a006\/12\/2013,\u00a0the\u00a0judge\u00a0denied the\u00a0request filled by Piraeus to annul the contestation for.\u00a0The next\u00a0court hearing\u00a0was\u00a0set on\u00a011\/09\/2013,\u00a0when\u00a0parties will be summoned again to\u00a0&#8222;discuss\u00a0the proofs&#8221;.\u00a0The solution\u00a0is apparently\u00a0favorable\u00a0to us\u00a0but we\u2019ll be able to have a conclusion only after\u00a0the decision of the judge will be drafted,\u00a0to find out\u00a0to what extent\u00a0the measures taken\u00a0were kept\u00a0by the court\u00a0(stamp duty to be paid\u00a0by each complainant, accountancy\u00a0expertise\u00a0&#8211; for which we\u00a0already paid\u00a0in\u00a0legal term the expert\u00a0fees\u00a0ordered\u00a0by the court).<\/p>\n<p>Best wishes,<\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Stimate Doamne,\u00a0 Stimati Domni, Adunarea Creditorilor de astazi nu a putut lua nicio hotarare din lipsa de cvorum.
